Ark. Code Ann. § 3-8-809

Failure to act on petition — Mandamus — Injunction

Acts 2015, No. 1251, § 5.

(1) If the county clerk does not examine and certify a petition under this chapter within the time prescribed in § 3-8-803, the sponsors may apply to the circuit court with jurisdiction for appropriate relief.

(2) If the court decides that the petition is legally sufficient, it shall order the county clerk to certify the sufficiency of the petition and set an election date.

(3) On a proper showing that any petition is not sufficient, the court may enjoin the county clerk from: Certifying its sufficiency; or

(4) Setting an election date.
