Remedies

Known as the Refund Anticipation Loan Act

The act spans §§ 4–4 (8 sections).

Acts 2009, No. 1402, § 1.

(1) A facilitator who violates a provision of this chapter is in violation of the Deceptive Trade Practices Act, § 4-88-101 et seq., and a consumer shall have all rights and remedies provided under this law.

(2) A facilitator who willfully fails to comply with any provision of this chapter is liable to the consumer for: Actual and consequential damages;

(3) Statutory damages of one thousand dollars ($1,000); and

(4) Reasonable attorney's fees and costs.
