Public display of obscenity

(1) As used in this subsection: “Obscene” means the same as “obscene material” defined by § 5-68-302; and

(2) “Obscenity” means an obscene sticker, painting, decal, emblem, or other device that is or contains an obscene writing, description, photograph, or depiction.

(3) A person commits the offense of publicly displaying an obscenity if the person knowingly causes an obscenity to be displayed in a manner that is readily visible to the public and the obscenity's content or character is distinguishable by normal vision.

(4) Publicly displaying an obscenity is a Class B misdemeanor.

(5) It is unlawful to publicly display obscene material as defined by § 5-68-302 on any motor vehicle or wearing apparel.

(6) A violation of this subsection is a Class C misdemeanor.
