Preemption and Interstate Collaboration

Known as the Responsible Battery Recycling Act

The act spans §§ 42420–42428 (26 sections).

Added by Stats. 2022, Ch. 351, Sec. 1

(a) This chapter preempts all rules, regulations, codes, ordinances, and other laws adopted by a city, county, city and county, municipality, or local agency on or after January 1, 2023, regarding stewardship programs for covered batteries.

(b) The Legislature finds and declares that the recycling of covered batteries is a matter of statewide concern and is not a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, this chapter applies to all cities, including charter cities.
