C.R.S. § 15-2.5-406

Power to contract

Known as the Colorado Uniform Powers of Appointment Act

The act spans §§ 15-2.5-101 to 15-2.5-603 (33 sections).

(1) A powerholder of a power of appointment that is not presently exercisable may contract to exercise or not to exercise the power only if the powerholder: (a) Is also the donor of the power; and (b) Has reserved the power in the instrument creating the power.
