Eminent domain

The act spans §§ 19-1-101 to 19-7-315 (377 sections).

(1) Intentionally left blank —Ed. (a) Subject to the provisions of subsection (2) of this section, the department of human services has the right to acquire by eminent domain any real property that is located within the Denver metropolitan area that is necessary for the establishment of one or more juvenile detention facilities. Such real property must be acquired in accordance with articles 1 to 7 of title 38. (b) Any real property specified in subsection (1)(a) of this section that is already devoted to a public use may be acquired by the department of human services pursuant to this section; except that property owned by the federal government may not be acquired without the consent of the federal government. (2) Prior to the acquisition of any real property pursuant to subsection (1) of this section, the joint budget committee, established pursuant to section 2-3-201 , must review and approve the proposed acquisition.
