(1) A surrogacy agreement is not considered: (a) An adoption pursuant to article 5 of this title 19; or (b) A surrender of custody or termination of parental rights of the child by the donor in violation of the requirements of article 3 of this title 19. (2) The payment of reasonable expenses and support in connection with a valid surrogacy agreement does not constitute a violation of section 19-5-213 .
