C.R.S. § 24-1-112

(1) There is hereby created a department of the treasury, the head of which shall be the state treasurer. (2) Intentionally left blank —Ed. (a) The department of the treasury, created in article 36 of this title 24, is a type 2 entity, as defined in section 24-1-105 , and exercises its powers and performs its duties and functions as specified by law and subject to the state constitution. (b) The office of the state treasurer is a type 2 entity, as defined in section 24-1-105 , and exercises its powers and performs its duties and functions as vested by law or the state constitution in the office of the state treasurer, subject to the state constitution.
