C.R.S. § 29-8-104

Known as the Colorado Underground Conversion of Utilities Act

The act spans §§ 29–29 (43 sections).

(1) The governing body of every county is authorized to create local improvement districts under this article within the unincorporated portion of such county, and the governing body of every city and town is authorized to create local improvement districts under this article within its territorial limits to provide for the conversion of existing overhead electric or communication facilities to underground locations and the construction, reconstruction, or relocation of any other electric or communication facilities which may be incidental thereto, under the provisions of this article. (2) The governing body of every municipal utility may, by resolution or ordinance, impose a surcharge on those consumers within such municipal utility’s service area who derive a direct benefit from the conversion of overhead electric and communication facilities to underground locations.
