C.R.S. § 8-67-104

(1) The following persons may not recover compensation or other benefits from the fund: (a) A partner in a partnership or an owner of a sole proprietorship; (b) A director or officer of a corporation; (c) A member or manager of a limited liability company; (d) An individual who was responsible for obtaining and maintaining the employer’s workers’ compensation insurance coverage and who failed to do so; (e) An individual who was eligible to be covered under a workers’ compensation insurance policy and voluntarily rejected the coverage under section 8-41-202 , 8-41-404 (4)(a)(V), or 8-41-404 (4)(a)(VI); (f) An individual who is not an “employee” as defined in sections 8-40-202 and 8-40-301 or who is otherwise ineligible to receive benefits under articles 40 to 47 of this title 8.
