Idaho Code § 30-21-810

Consequences of noncompliance

I.C., § 30-21 -810, as added by 2015, ch. 243, § 14, p. 758.

(1) Any person who transacts business in Idaho under an assumed business name without having complied with the requirements of this chapter [part] shall not be entitled to maintain any legal action in the courts of this state until the person has filed a certificate of assumed business name as required by this chapter [part].

(2) Any person who suffers a loss because of another person’s noncompliance with the requirements of this chapter [part] shall be entitled to recover damages in the amount of the loss and attorney’s fees and costs incurred in connection with recovery of damages.

(3) Noncompliance shall be held to include false, misleading or incomplete information in a certificate of assumed business name, as well as failure to file.
