Idaho Code § 31-4304A

Creation of a planned unit development recreation district

I.C., § 31-4304A, as added by 1995, ch. 353, § 1, p. 1193.

A recreation district may be created by a planned unit development created pursuant to section 67-6515, Idaho Code, applicable to the boundaries of the planned unit development as created by county permit pursuant to the following special terms and provisions:

(1) A “qualified elector” as defined in section 31-4303, Idaho Code, shall include a person owning real property in the proposed district.

(2) Upon receipt of a petition signed by sixty percent (60%) of the qualified electors in a planned unit development to form a recreation district, the board of county commissioners shall issue an order so finding a district has been formed as if an election had been held pursuant to section 31-4304, Idaho Code.

(3) The provisions of subsections (f) and (g) of section 31-4304, Idaho Code, shall apply to initial appointment of a board of directors for a district organized pursuant to this section. Additionally, the provisions of this chapter shall apply to the provisions of a district organized pursuant to this section.
