Idaho Code § 39-1313

Injunction to prevent operation without license. — Notwithstanding the existence or pursuit of any other remedy, the licensing agency may in the manner provided by law maintain an action in the name of the state for injunction or other process against any person or governmental unit to restrain or prevent the establishment, conduct, management or operation of a facility or agency as defined, without a license under sections 39-1301

The licensing agency shall be represented by the county prosecutor of the county in which the violation occurs or by the office of the attorney general.
