Idaho Code § 41-1096

No negative option or opt out

Known as the Limited Lines Travel Insurance Act

The act spans §§ 41–41 (65 sections).

No person offering travel insurance on an individual or group basis may do so using a negative option or option to opt out, that would require a consumer to take an affirmative action to deselect coverage such as unchecking a box on an electronic form when purchasing a trip. It shall not be an unfair trade practice to include blanket travel insurance coverage with the purchase of a trip, provided the coverage is not marketed as free.
