Procedures for selection

Known as the Innovations for Transportation Infrastructure Act

(a) The Transportation Agency shall review, evaluate, score, and rank proposals and determine which proposal offers the best value to the public based on the evaluation criteria set forth in the request for proposals. The Transportation Agency shall award the contract based on this determination. Notwithstanding other provisions of this Section, if for any reason the proposer awarded the contract is unable or unwilling to execute the contract, including the failure of the proposer and the Transportation Agency to successfully complete negotiations, if any, of the contract, the Transportation Agency may award the contract to the proposer whose proposal the Transportation Agency determines offers the public the next best value. (b) After a response to a request for qualifications or a request for proposals has been submitted as provided in Section 25, a design-builder shall not replace, remove, or otherwise modify any firm identified as a member of the proposer team unless authorized to do so by the Transportation Agency.
