(a) The court may not enter a workplace protection restraining order that enjoins the following activities: (1) lawful monitoring of compliance with public or worker safety laws, wage and hour requirements, or other statutory workplace requirements; (2) lawful picketing, patrolling, using a banner, or other lawful protesting at the workplace which arises out of a bona fide labor dispute; and (3) engaging in concerted and protected activities as defined in applicable labor law. (b) As used in this Section, "bona fide labor dispute" means any activity recognized as a labor dispute by the National Labor Relations Act, the Illinois Public Labor Relations Act, or the Illinois Educational Labor Relations Act, and includes a controversy concerning: wages, salaries, hours, working conditions, or benefits, including health and welfare, sick leave, insurance, and pension or retirement provisions; the terms to be included in collective bargaining agreements; and the making, maintaining, administering, and filing of protests or grievances under a collective bargaining agreement.
