Ind. Code § 5-10.1-2.5-1

Sec. 1. As used in this chapter, "sick pay plan" means a plan that:

(1) provides for an employer to make payments in lieu of wages to employees on account of sickness or accident disability; and

(2) meets the requirements of 42 U.S.C. 409(b) or (d).
