Sec. 3. As used in this chapter, "eligible utility" means:
(1) a public utility;
(2) a municipally owned utility; or
(3) a not-for-profit utility;
that provides water or wastewater service to the public and is under the jurisdiction of the commission for the approval of rates and charges.
