Petitions for adoption of children placed for adoption by the cabinet or a licensed child- placing institution or agency shall not be denied:

(1) On the basis of the religious, ethnic, racial, or interfaith background of the adoptive applicant, unless contrary to the expressed wishes of the biological parent or parents; or (2) On the sole basis of a disability of the adoptive applicant without considering whether targeted adaptive or supportive services could enable the applicant to provide essential care and protection for the child.
