Biosolids -- Designation as special waste -- Administrative regulations for siting and permitting of biosolids disposal

(1) As used in this section, "biosolids" means nutrient-rich, organic, residual material that results from the treatment of domestic sewage or sewage sludge in a treatment facility and can be recycled and applied as a fertilizer to improve and maintain productive soils.

(2) Notwithstanding any provision of law to the contrary, when biosolids are generated from wastewater treatment at a publicly owned treatment works, the biosolids shall be:

(a) Designated a special waste; and (b) Regulated in conformance with the most recent version of 40 C.F.R. pt.

503.

(3) Within sixty (60) days of June 29, 2023, the cabinet shall promulgate administrative regulations pursuant to KRS Chapter 13A that are in conformance with 40 C.F.R. pt. 503, regarding siting criteria and permitting conditions necessary to regulate the disposal of biosolids.
