KRS 304.17A-599

Commissioner review of alleged violations of KRS 304.17A-593, 304.17A-595, or 304.17A-597

(1) Any insured, pharmacy, or pharmacist impacted by an alleged violation of KRS 304.17A-593, 304.17A-595, or 304.17A-597 may file a complaint with the commissioner.

(2) The commissioner shall:

(a) Review and investigate all complaints filed under this section;

(b) Issue, in writing, a determination to the insured, pharmacy, or pharmacist as to whether a violation occurred;

(c) For alleged violations of KRS 304.17A-595(2)(b)5., consult with the Kentucky Board of Pharmacy in making the determination of whether a violation occurred; and (d) Otherwise comply with KRS 304.2-160 and 304.2-165.

(3) An insurer, a pharmacy benefit manager, or any other administrator of pharmacy benefits shall comply with KRS 304.2-165 and otherwise respond to, and comply with, any requests made by the commissioner under this section.
