Cabinet to file petition within 72 hours if child remains placed outside of home during child protective services investigation under agreed upon safety plan -- Cabinet to report on safety plans

(1) During a child protective services investigation conducted pursuant to the authority in this chapter where there is a safety plan negotiated and agreed upon between the cabinet and the parent, guardian, person in a position of authority or special trust, as defined in KRS 532.045, or other person having custodial control or supervision of the child or responsibility for his or her welfare that the child cannot safely remain in the home, the cabinet shall file a petition in court within seventy-two (72) hours if the child remains placed outside of his or her home for more than fourteen (14) consecutive days.

(2) All safety plans implemented pursuant to this section shall be compiled by the cabinet on a quarterly basis into a report containing at a minimum the total number of safety plans, the outcome of the safety plans, and the number of court petitions filed.

(3) By December 1, 2024, and quarterly thereafter, the cabinet shall make available, on its website and to the Legislative Research Commission for referral to the Interim Joint Committee, Senate Standing Committee, and House Standing Committee on Families and Children, the report on safety plans established in subsection (2) of this section.
