Incidental by-catch

Acts 1997, No. 1163, §1, eff

Any commercial shrimping vessel may retain and any commercial fisherman may sell all southern flounder caught as by-catch on any shrimping trip unless the southern flounder stock is determined by the department to be overfished or undergoing overfishing. After such a determination, the commission may adopt rules or regulations in accordance with the Administrative Procedure Act to restrict the retention of southern flounder caught as by-catch on any shrimping trip until such time as the department determines the stock has recovered from an overfished or overfishing status.
