Indemnity

Known as the Louisiana Conservation Servitude Act

The act spans §§ 9–9 (26 sections).

Acts 2025, No. 27, §2.

A. The owner of a dominant estate having a utility servitude under this Chapter is bound to indemnify the owner of the servient estate for any damage caused by the exercise of the servitude.

B. The right to demand indemnity against the owner of the dominant estate may become barred by prescription. The accrual of prescription has no effect on the utility servitude.
