Whoever refuses or neglects, after request, to return a note or other evidence of a loan which is discharged or entitled to be discharged under section ninety, or to discharge a mortgage or to restore the property held as a pledge as provided in section ninety-one, shall be liable in tort to the borrower for all damages resulting to him from any violation of this section or section ninety-one.
