Mass. Gen. Laws ch. 223, § 118

Liability of creditor for proceeds paid over to him

If the officer in such case has, before such demand, paid over the proceeds of the sale to the judgment creditor, he shall not be liable therefor, but the executor or administrator, if appointed as before provided, may recover in a civil action from the judgment creditor the amount so paid to him.
