Mass. Gen. Laws ch. 228, § 13

Insanity of party during pendency of action

If, during the pendency of an action or suit, any party becomes insane, it may be prosecuted or defended by his guardian in like manner as if it had been commenced after the appointment of the guardian, or the court may appoint a guardian for the action, as the case may require.
