Mass. Gen. Laws ch. 241, § 30

Trusteeship, etc.; effect on partition

The fact that a cotenant is, alone or jointly with others, as trustee or in any other representative capacity, the holder of the legal title to a share in which he has no beneficial interest shall not prevent partition.
