Mass. Gen. Laws ch. 261, § 15

Action by state in behalf of private parties; effect on costs

A private person at whose relation, for whose use or in whose behalf an action or proceeding is commenced in the name of the commonwealth or of the attorney general shall be liable for costs, as if it had been begun in his own name.
