Mass. Gen. Laws ch. 30, § 44A

Land owned by commonwealth; sale to counties, etc.; highway purposes

A commissioner or head of a state department having control of any land of the commonwealth may, in the name of the commonwealth and subject to the approval of the governor and council, sell and convey to any county, city or town, or transfer to the control of another state department, so much of such land as may be necessary for the laying out or relocation of any highway.
