Mass. Gen. Laws ch. 84, § 8

Fences, gates or bars to prevent spread of disease; removal

No surveyor, road commissioner or other person shall, without an order from the board of health, remove or take down fences, gates or bars which have been placed on a way for the purpose of preventing the spread of a disease dangerous to the public health.
