Whoever violates any provision of section forty shall be punished for the first offence by a fine of not less than ten nor more than one hundred dollars, for the second offence by a fine of not less than fifty nor more than three hundred dollars, and for a subsequent offence by a fine of fifty dollars and by imprisonment for not less than one nor more than two months.
