Sec. 120. (1) An individual subject to this code is guilty of sexual assault and must be punished as a court-martial directs if the individual engages in sexual contact with another individual by any of the following means: (a) By forcible compulsion. (b) By engaging in sexual conduct with an individual who is incapable of consent because the individual is any of the following: (i) Physically helpless. (ii) Mentally defective. (iii) Mentally incapacitated. (c) By abuse of authority. (2) As used in this section, "sexual contact" means touching by any part of the body or an object, or causing another individual to touch, either directly or through the clothing, the vulva, penis, scrotum, anus, groin, breast, inner thigh, or buttocks of any individual, with an intent to abuse, humiliate, harass, or degrade any individual or to arouse or gratify the sexual desire of any individual.
