Common carriers; charges and overcharges; definitions

Sec. 5811. (1) All actions by common carriers for the recovery of all or any part of their charges arising out of the intrastate transportation of persons or property within the state of Michigan, and all actions against carriers for the recovery of overcharges collected by common carriers for the intrastate transportation of persons or property within the state of Michigan shall be begun within 2 years of the time the claim accrues and not afterwards. (2) The term "charges" as used in this section means the charges applicable for transportation services under the tariffs lawfully on file with the Michigan public service commission; and the term "overcharge" as used in this section means charges for transportation services in excess of the tariffs lawfully on file with the Michigan public service commission.
