DISCLOSURE OF COMMUNICABLE DISEASE.

Subdivision 1. Licensed foster care.

This section applies to county agencies, private child-placing agencies, and individuals who place children or youth who have a known communicable disease, as defined in section 144.4172, subdivision 2 , in foster care settings licensed under this chapter.

Subd. 2. Placing agency's or individual's duties.

Notwithstanding sections 144.291 to 144.298 , before a county agency, private child-placing agency, or individual places a child or youth with a known communicable disease with a licensed foster care provider, the agency or individual must:

(1) disclose to the foster care license holder the child's communicable disease; and

(2) determine that the foster care provider has the ability to provide care to the child or youth.
