SWING BED APPROVAL; EXCEPTIONS.

Subdivision 1. Swing bed exemption.

(a) The conditions and limitations in section 144.562 , paragraphs (d) and (e), do not apply to any hospital located in Cook County that:

(1) is designated as a critical access hospital under section 144.1483 , clause (9), and United States Code, title 42, section 1395i-4; and

(2) has an attached nursing home.

(b) Any swing bed located in a hospital described in this section may be used to provide nursing care without requiring a prior hospital stay.

(c) The nursing care provided to a patient in a swing bed is a covered medical assistance service under section 256B.0625, subdivision 2b .

Subd. 2. Application of the health care bill of rights.

A patient in a swing bed located in a hospital described in this section is a resident of a nursing home for the purposes of section 144.651 .

Subd. 3. Comprehensive resident assessment.

A patient in a swing bed located in a hospital described in this section is a resident of a nursing home for the purposes of Minnesota Rules, part 4658.0400 .
