Department created, duties — definitions

Known as the Professional Bail Bondsman and Surety Recovery Agent Licensure Act

1. The department of insurance created by Section 36(b) of Article IV of the Missouri Constitution shall operate under the name "Department of Commerce and Insurance". Under the authority of the Omnibus State Reorganization Act of 1974 and executive order 06-04, the department shall administer and enforce the laws assigned to the department.

2. Unless otherwise clearly indicated by the context, the following words, as used in this chapter, mean:

(1) "Department", the department of commerce and insurance; and

(2) "Director", the director of the department of commerce and insurance.

3. Wherever the laws, rules, or regulations of this state make reference to the "department of insurance" or the "department of commerce and insurance", such references shall be deemed to refer to the department created by Section 36(b) of Article IV of the Missouri Constitution and this chapter.
