Civilian officers to execute required duties, failure to perform, penalty

Effective: 28 Aug 1984; (L. 1984 H.B. 1035 § 130)

The neglect or refusal of any sheriff, police officer, jail warden or magistrate to execute any process, or to make proper return of all fines and penalties collected, or to receive in custody any prisoner, shall be deemed a class C misdemeanor and shall subject the offender to a prosecution by the proper prosecuting attorney.
