Wastewater Advisory Council created; purpose; composition [Repealed effective July 1, 2023]

Known as the Mississippi Individual On-Site Wastewater Disposal System Law

The act spans §§ 41–41 (30 sections).

(1) There is created the Wastewater Advisory Council for the purpose of advising the department regarding individual on-site wastewater disposal systems. The advisory council shall be composed of the following: One (1) appointee of the State Health Officer;

(2) One (1) appointee of the Chairman of the State Board of Health;

(3) One (1) appointee of the Chairman of the State Board of Health that represents a Mississippi Aerobic Treatment Unit (ATU) manufacturer;

(4) One (1) appointee of the Chairman of the State Board of Health that represents a certified installer;

(5) One (1) appointee of the Chairman of the State Board of Health that represents a septic tank or aggregate disposal manufacturer;

(6) One (1) appointee of the Executive Director of the Mississippi Department of Environmental Quality;

(7) One (1) appointee of the Executive Director of the Office of Pollution Control;

(8) One (1) appointee of the Executive Director of the Mississippi Soil and Water Conservation Commission;

(9) One (1) appointee of the Director of the Mississippi State Board of Registered Professional Geologists;

(10) One (1) appointee of the Chairman of the Department of the Mississippi State University School of Civil and Environmental Engineering Companies;

(11) The federally appointed Mississippi State Soil Scientist, or his designee;

(12) One (1) appointee of the Executive Director of the American Council of Engineering Companies;

(13) One (1) appointee of the Executive Director of the Home Builders Association of Mississippi;

(14) One (1) appointee of the Executive Director of the Mississippi Engineering Society;

(15) One (1) appointee of the Executive Director of the Mississippi Manufactured Housing Association;

(16) One (1) appointee of the Executive Director of the Mississippi Rural Water Association;

(17) One (1) appointee of the Executive Director of the Mississippi Association of Supervisors;

(18) One (1) appointee of the President of the Mississippi Pumpers Association;

(19) One (1) appointee of the President of the Mississippi Water and Pollution Control Operators Association, Inc.;

(20) One (1) appointee of the Executive Director of the Mississippi Association of Realtors; and

(21) One (1) appointee of the Executive Director of the Mississippi Municipal League.

(22) The members of the advisory council shall elect a chairman and vice chairman from its membership.

(23) The terms of appointments for each member shall be for a period of two (2) years.

(24) The advisory council shall have quarterly meetings, with at least one (1) of those meetings taking place between forty-five (45) and sixty (60) days before the meeting of the board.

(25) The department shall staff all advisory council meetings and record minutes of those meetings.
