Notice of hearing generally

Known as the Mississippi Guardianship and Conservatorship Act

The act spans §§ 93–93 (84 sections).

(1) Except as otherwise provided in Section 93-20-203, 93-20-303(3), or 93-20-403(3), if notice of a hearing under this chapter is required, the movant must give notice of the date, time, and place of the hearing to the person to be notified unless otherwise ordered by the court for good cause shown. Except as otherwise provided in this chapter, notice must be given in compliance with Rule 81 of the Mississippi Rules of Civil Procedure.

(2) Proof of notice of a hearing under this chapter must be made before or at the hearing and filed in the proceeding.

(3) Notice of a hearing under this chapter must be in at least sixteen-point font, in plain language, and, to the extent feasible, in a language in which the person to be notified is proficient.

(4) Any person interested in the ward’s welfare may file a motion to intervene as provided by Rule 24 of the Mississippi Rules of Civil Procedure.
