Miss. Code Ann. § 93-20-306

Rights at hearing

Known as the Mississippi Guardianship and Conservatorship Act

The act spans §§ 93-20-101 to 93-20-431 (84 sections).

Laws, 2019, ch. 463, § 1, eff from and after January 1, 2020.

(1) At a hearing held under Section 93-20-303, the respondent may: Present evidence and subpoena witnesses and documents;

(2) Examine witnesses; and

(3) Otherwise participate in the hearing.

(4) Unless excused by the court for good cause shown, a proposed guardian must attend a hearing under Section 93-20-303.

(5) A hearing under Section 93-20-303 must be closed upon request of the respondent and a showing of good cause.

(6) Any person may request to participate in a hearing under Section 93-20-303. The court may grant the request, with or without a hearing, on determining that the best interest of the respondent will be served. The court may impose appropriate conditions on the person’s participation.
