Right to counsel

Known as the Montana Indian Child Welfare Act

The act spans §§ 41–41 (22 sections).

In a child custody proceeding under this part in which the court determines that the Indian child's parent or Indian custodian is indigent, the parent or Indian custodian has the right to court-appointed counsel. The court may, in its discretion, appoint counsel for the Indian child pursuant to 41-3-425.
