Mont. Code Ann. § 50-12-103

Availability of experimental treatments

Known as the Right to Try Act

The act spans §§ 50-12-101 to 50-12-110 (10 sections).

(1) A manufacturer, health care provider, or health care facility may make an experimental treatment available upon a patient's request.

(2) The manufacturer, health care provider, or health care facility may:

(a) provide an experimental treatment to a patient without receiving compensation; or

(b) establish payment arrangements with a patient for an experimental treatment.

(3) A manufacturer, health care provider, or health care facility is not required to make an experimental treatment available to a patient.
