Mont. Code Ann. § 50-30-107

Powers and duties of department's agents

Known as the Montana Consumer Product Safety Act

The act spans §§ 50-30-101 to 50-30-307 (35 sections).

(1) For enforcement of this chapter, officers or employees duly designated by the department, upon presenting appropriate credentials to the owner, operator, or agent in charge, are authorized to:

(a) enter at reasonable times a factory, warehouse, or establishment in which hazardous substances are manufactured, processed, packed, or held for introduction into commerce or are held after introduction;

(b) enter a vehicle being used to transport or hold hazardous substances in commerce;

(c) inspect at reasonable times, within reasonable limits, and in a reasonable manner a factory, warehouse, establishment, or vehicle and all pertinent equipment, finished and unfinished materials, and labeling in the factory, warehouse, establishment, or vehicle; and

(d) obtain samples of materials or packages or labeling.

(2) If the officer or employee obtains a sample, prior to leaving the premises the officer or employee shall pay or offer to pay the owner, operator, or agent in charge for the sample and give a receipt describing the samples obtained.
