N.H. Rev. Stat. Ann. § 104:24

When an execution against the estate of a sheriff is returned unsatisfied the creditor may give notice thereof to such sheriff, and, if the execution, with the costs of such notice, is not paid within 40 days after the notice is given, the court shall remove him from office.
