Attorneys' Fees

Known as the Uniform Trade Secrets Act

The act spans §§ 350-B:1 to 350-B:9 (9 sections).

The court may award reasonable attorneys' fees to the prevailing party when:

I. A claim of misappropriation is made in bad faith;

II. A motion to terminate an injunction is made or resisted in bad faith; or

III. Willful and malicious misappropriation exists.
