1. The Department shall:
(a) Maintain a publicly available Internet website to inform the public concerning violations of NRS 439B.2801 to 439B.2839, inclusive; and
(b) Not later than 30 days after finding, after notice and the opportunity for a hearing in accordance with NRS 439B.2833 and 439B.2835 and the regulations adopted pursuant thereto, that a hospital has violated any provision of NRS 439B.2801 to 439B.2839, inclusive, post to the Internet website maintained pursuant to paragraph (a):
(1) The name of the hospital;
(2) A description of the violation that the hospital was found to have committed;
(3) Any corrective action that the hospital was ordered to take pursuant to NRS 439B.2835 or included in a plan of correction approved pursuant to that section and, if applicable, the date on which the hospital took such corrective action; and
(4) The amount of any administrative penalty imposed on the hospital pursuant to NRS 439B.2837.
2. Except as otherwise provided in subsection 3 and NRS 239.0115, a complaint filed with the Department pursuant to NRS 439B.2833, all documents and other information filed with the complaint and all documents and other information compiled as a result of an investigation conducted to determine whether to issue a notice of violation pursuant to NRS 439B.2835 are confidential.
3. Any notice provided by the Department, plan of correction approved by the Department or confirmation that a hospital has taken a corrective action required by the Department pursuant to NRS 439B.2835, any order of the Department imposing an administrative penalty pursuant to NRS 439B.2837 and any documents or information considered by the Department when determining whether to approve a plan of correction or impose an administrative penalty are public records.
