“Solid waste management authority” means:
1. Except as otherwise provided in subsection 2, the district board of health of a health district if the district board of health is designated pursuant to NRS 444.503 to carry out the provisions or limited provisions of NRS 444.440 to 444.620, inclusive, and any regulations adopted pursuant thereto.
2. In all other areas of the State and pursuant to NRS 704.7318, at any site previously used for the production of electricity from a coal-fired electric generating plant in this State, the Division of Environmental Protection of the State Department of Conservation and Natural Resources.
