§ 34.03. Definitions. The following terms as used in this article\nshall have the following meanings:\n 1. "Performing group" means any vocal or instrumental group seeking to\nuse, using, advertising the use of, or promoting the name of a recording\ngroup that has previously released a commercial sound recording under\nthe name of such recording group.\n 2. "Recording group" means any vocal or instrumental group at least\none of whose members has previously released a commercial sound\nrecording under that group's name and in which such member or members\nhave a legal right by virtue of use or operation under the group name\nwithout having abandoned the name or affiliation with the group.\n 3. "Sound recording" means any work that results from the fixation on\na material object of a series of musical, spoken or other sounds\nregardless of the nature of the material object, including, but not\nlimited to, a disk, tape, computerized file or other phono-record, in\nwhich the sounds are embodied.\n
