§ 12-106. Warranties and service agreements. 1. All express warranties\nand service agreements pertaining to any solar thermal system or\ncomponent thereof which is sold in the state shall be in writing and\nshall be in compliance with rules and regulations to be promulgated by\nthe commissioner. Such rules and regulations shall contain standards no\nless stringent than those contained in the Federal Magnuson-Moss\nWarranty Act (15 U.S.C. §§ 2301 et seq.) and the rules and regulations\nissued pursuant thereto.\n 2. All customers shall be provided with express warranties which shall\ninclude at a minimum the following:\n (a) A full one year warranty by the installer against malfunction or\nfailure of a solar thermal system due to improper installation or a\ndefect in standard pipe, ducts, switchboxes and hardware utilized in\ninstallation;\n (b) A full one year warranty by the system manufacturer and the seller\nagainst a defect in materials, manufacture or design of a solar thermal\nsystem; and\n (c) A full three year warranty by the system manufacturer and the\nseller against a defect in materials, manufacture or design of a solar\ncollector, tank or heat exchanger.\n 3. No person shall offer a service agreement for a solar thermal\nsystem unless such person shall have developed a service capability for\nsuch system.\n
